No-one sets out to recruit a difficult employee but it’s a fact of business life that at some point you will encounter a difficult employee who seems at their happiest when they’re pulling in the opposite direction to everyone else. The type of employee who regularly locks horns with their managers and colleagues is that same type of employee who will most likely take you to an Employment Tribunal.

What are the right steps to take when an employee’s behaviour in the workplace is becoming “a problem”? They may be arriving late or leaving early, taking days off, or generally not performing to their best. Is the employee facing health or personal difficulties? How should you, as an employer, ensure you support that employee, but also minimise disruption to the business (and to other employees)?

We’ll explore some of the areas below, discussing how best to prevent a bad situation from getting worse:

  • Investigating employee problems and offering support
  • Conduct or capability issue?
  • Seeking the opinion of a medical professional
  • Complaints and grievances
  • Warnings and disciplinaries
  • Ways to end employment
